1. About these terms

This website is operated by Mortgage Superheroes Pty Ltd (ABN [ABN]), Australian Credit Licence [Australian Credit Licence number]. In these terms, “we”, “us” and “our” mean Mortgage Superheroes, and “you” means anyone using this site.

By using this website you accept these terms. If you do not accept them, please stop using the site. These terms cover the website itself — the credit assistance we provide is governed separately by our credit guide, our credit proposal, and any agreement you sign with us.

2. Using this website

You are welcome to browse this site, read anything on it, and print or save pages for your own personal use. A few things are off limits.

• Do not use the site for anything unlawful, misleading or fraudulent.
• Do not attempt to reach any part of the site, server or account you are not authorised to access.
• Do not scrape, harvest or bulk-copy content from the site, or run automated tools against it in a way that interferes with how it works.
• Do not upload or transmit anything containing malicious code, or anything that would damage, disable or overload the site.
• Do not submit another person's details through a form on this site unless you are entitled to do so.

We may suspend, withdraw or restrict access to the site, or to any part of it, at any time and without notice.

3. What we do

We are mortgage brokers. We work with you to understand what you need, compare loan products from the lenders on our panel, and prepare and submit an application on your behalf.

We are not a lender and we do not approve loans. Every credit decision — approval, decline, the rate, the conditions — is made by the lender against its own criteria. Nothing on this site is an offer of credit or a pre-approval.

Lender products, rates, fees and lending policies change regularly, sometimes without notice to us. Anything you read here about a product is a general description, not a quote and not a commitment.

4. Information on this site is general only

The content on this website is general information. It does not take into account your objectives, financial situation or needs, and it is not personal credit, financial, taxation or legal advice.

Before you act on anything here, consider whether it is right for you and get advice specific to your circumstances. Where a product is involved, read the lender's own documents in full before you commit to anything.

Calculators, examples and figures on this site are illustrations only. They rest on assumptions that may not match your situation, and they are not an offer, an approval, or a promise of what you can borrow.

5. Enquiries and the information you give us

Sending us an enquiry through this site does not create a client relationship and does not guarantee that finance will be available to you. We will come back to you and, if we can help, explain what happens next.

When you give us information — through a form, by email, or in conversation — you agree that it is accurate and complete as far as you know, and that you are entitled to give it to us. We rely on what you tell us when we approach a lender, and a lender may decline an application built on information that turns out to be wrong.

Everything you send us is handled in accordance with our Privacy Policy.

6. How we are paid

We are generally paid a commission by the lender when a loan we arrange settles, and in some cases a trail commission while that loan runs.

Where a fee is payable by you, we will tell you what it is and what it is for, in writing, before you are committed to it. Our credit guide and credit proposal set out how we are paid on your particular application.

7. Links to other websites

This site links to lenders, government bodies, calculators and other third-party websites. We include those links because they may be useful to you, not as an endorsement of the site or anything on it.

We do not control those sites and we are not responsible for their content, their accuracy, their availability or their privacy practices. Their terms apply the moment you leave ours, so read them.

8. Intellectual property

The content on this site — text, layout, graphics, illustrations, photographs, logos and the design of the site itself — is owned by us or licensed to us, and is protected by copyright and trade mark law.

Other than the personal use described above, you may not reproduce, republish, adapt, distribute or commercially exploit any of it without our written permission. Our name, our hero characters and our logos are our trade marks and may not be used without permission.

9. Availability and accuracy of the site

We take reasonable care to keep this site accurate and current, but we do not warrant that it is complete, up to date or free of errors. Information can go out of date the moment a lender changes a policy.

The site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, secure or free of viruses, and we may change, suspend or remove any part of it at any time without notice.

10. Our liability

Nothing in these terms excludes, restricts or modifies any right, remedy, guarantee, warranty or other term implied by the Australian Consumer Law or by any other law that cannot lawfully be excluded.

Subject to that, and to the maximum extent permitted by law, we are not liable for any loss or damage — including indirect or consequential loss, loss of profit, or loss of opportunity — arising out of your use of this site or your reliance on anything published on it.

Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant information or paying the cost of having it re-supplied.

13. Governing law
